Anwar given till Nov 18 to file affidavit-in-reply

KUALA LUMPUR: The Syariah Appeals Court here yesterday gave Opposition Leader Datuk Seri Anwar Ibrahim until Nov 18 to file an affidavit-in-reply to a notice issued by the Federal Territories (FT) chief syarie prosecutor and two others in connection with his appeal on a ‘qazaf’ case.

Its chief registrar Abdul Razali Kefli set the date after meeting counsel Zainul Rijal Abu Bakar and Roslizam Rahim, who represented FT chief syarie prosecutor Shamsuddin Hussain, FT Islamic Religious Department director (Jawi) Datuk Che Mat Che Ali and Minister in the Prime Minister’s Department Datuk Jamil Khir
 Baharom and Anwar’s counsel Dorina Abdullah.

Zainul said the notice of appeal filed by Anwar, who is also the Member of Parliament for Permatang Pauh, did not follow the right procedures.

Anwar, 63, on April 23 had filed the appeal after the Syariah High Court dismissed his application to initiate ‘qazaf’ (false accusation) proceedings against his former aide, Mohd Saiful Bukhari Azlan.

On May 14, Shamsuddin, Che Mat and Jamil Khir, as the applicants, had applied to strike out Anwar’s appeal on the grounds that his notice of appeal was defective. On Jan 7, Anwar had applied to the Syariah

High Court to compel the trio, who he had named as the respondents, to initiate prosecution proceedings against Mohd Saiful, citing that the latter had made false sodomy accusations about him (Anwar).

On Feb 9, the respondents had filed a preliminary objection against Anwar’s ‘qazaf’ application citing that the Syariah High Court did not have jurisdiction to hear an alleged sodomy case as this came under the purview of the civil criminal court.
